After days of trying unsuccessfully to change its nomination list with the IEBC, Amani National Congress will now have to put up with its Nominated MP, Geodfrey Osotsi’s love for Raila Odinga. The Independent Electoral and Boundary Commission (IEBC) has rejected ANC’s move to have Osotsi ejected from parliament.
“Accordingly, the party now considers the present list obsolescent and would wish to resubmit a reviewed list for future consideration, in line with 37(2) of the Election Act,” read a section of ANC’s letter to the IEBC concerning the issue.
The commission was not convinced that ANC has any sufficient evidence and solid grounds to effect its nominations list submitted to the IEBC in 2017 and told off the party, citing illegality. Osotsi has been at the cross hairs of his party because of his ardent support of Raila Odinga and publicly disagreeing with his party leader Musalia Mudavadi on a number of issues of national prominence.
In a letter to the ANC, IEBC Chair Wafula Chebukati says he would only effect changes to the list of nominees as required by ANC only if the party showed the commission that there were sufficient grounds to remove the vocal nominated MP.Adding that the list of 98 people nominated by the party in 2017 would be valid until 2022 unless for reasons provided by the law.
“Any issue about the nominees on the present lists must therefore be supported by the relevant proof and or evidence before the commission can accept a new party list,” the letter reads in part. He also argued that unless there was evidence indicating that due process had been followed, the commission would not allow for the reallocation of seats in the party.
